1. GENERAL INFORMATION AND ACCEPTANCE
These Terms and Conditions (“Terms”) govern your use of the Taupo Garden Sheds website and the purchase of products and services from Taupo Garden Sheds (“Company”, “we”, “us”, “our”). By accessing our website or placing an order, you (“Customer”, “you”, “your”) agree to be bound by these Terms.
2. PRODUCTS AND SERVICES
2.1 Product Range We sell Duratuf Garden Sheds and related products (“Products”). All product specifications, dimensions, colours, and features are as described on our website or in manufacturer documentation.
2.2 Installation Services We offer optional installation services for purchased sheds. Installation is subject to site conditions, accessibility, and separate installation terms.
2.3 Product Availability All products are subject to availability. We reserve the right to discontinue products or modify specifications without notice.
3. PRICING AND PAYMENT
3.1 Pricing All prices are in New Zealand Dollars (NZD) and include GST unless otherwise stated. Prices are subject to change without notice.
3.2 Payment Terms
- Full payment is required before delivery unless credit terms have been specifically arranged
- We accept major credit cards, bank transfers, and other payment methods as displayed
- Payment processing fees may apply
3.3 Additional Costs Delivery charges, installation fees, and any site preparation costs are additional and will be clearly stated before order confirmation.
4. ORDERS AND CONTRACTS
4.1 Order Process
- Online orders placed through our website generate an automatic order receipt email
- Orders are not binding until we provide written order acceptance (“Order Acceptance”)
- Order Acceptance occurs when we review your order and confirm availability, pricing, and delivery details
- We reserve the right to refuse or cancel any order before Order Acceptance
- Order Acceptance constitutes acceptance of these Terms
4.2 Order Modifications Changes to orders may not be possible after Order Acceptance and may incur additional charges if accepted.
5. DELIVERY
5.1 Delivery Terms
- Delivery timeframes are estimates only and not guaranteed
- Delivery is to kerbside unless otherwise arranged
- Customer must ensure reasonable access for delivery vehicles
- Additional charges apply for difficult access or special delivery requirements
5.2 Delivery Delays We are not liable for delays caused by weather, traffic, supplier delays, or circumstances beyond our control.
5.3 Failed Delivery If delivery cannot be completed due to customer unavailability or site access issues, redelivery charges will apply.
6. INSTALLATION SERVICES
6.1 Site Requirements
- Customer is responsible for ensuring the installation site is properly prepared
- Site must have level ground, adequate access, and meet local building requirements
- Customer must obtain all necessary permits and consents before installation
6.2 Site Assessment
- We may conduct a site assessment before installation.
- Additional charges may apply if site conditions differ from initial assessment.
6.3 Installation Limitations We are not responsible for:
- Underground services (customer must arrange location marking)
- Existing structures or landscaping
- Site preparation beyond basic levelling
- Building consents or compliance issues
7. CUSTOMER RESPONSIBILITIES
7.1 Product Selection
- Customer is solely responsible for selecting appropriate products for their needs
- Customer must verify all specifications, dimensions, and suitability
- We provide information in good faith but make no warranties regarding suitability
7.2 Site Preparation
- Customer must prepare the installation site according to provided specifications
- Customer must ensure compliance with local building codes and regulations
- Customer must mark location of all underground services
7.3 Access and Safety
- Customer must provide safe and reasonable access to the installation site
- Customer must inform us of any site hazards or special conditions
8. WARRANTIES AND LIABILITY
8.1 Product Warranties
- Products are covered by manufacturer warranties as provided by Duratuf
- Full manufacturer warranty terms are available via this link or upon request
- We act as intermediary for warranty claims but provide no additional product warranties beyond those offered by the manufacturer
- Warranty claims must be made in accordance with manufacturer procedures and timeframes
- Customers should retain all purchase documentation for warranty purposes
8.2 Installation Warranty
We warrant our installation workmanship for 12 months from completion, subject to:
- Normal use and maintenance
- No modifications by customer or third parties
- Compliance with manufacturer specifications
8.3 Limitation of Liability To the maximum extent permitted by law:
- Our liability is limited to the purchase price of products/services
- We exclude liability for indirect, consequential, or punitive damages
- We are not liable for delays, site conditions, or circumstances beyond our control
8.4 Consumer Guarantees
Nothing in these Terms excludes or limits rights under the Consumer Guarantees Act 1993 or other mandatory consumer protection laws.
9. RETURNS AND CANCELLATIONS
9.1 Order Cancellation
- Orders may be cancelled before Order Acceptance without penalty
- After Order Acceptance, cancellation may be subject to cancellation fees and restocking charges
- Custom orders and cut-to-size products cannot be cancelled once production has commenced
- Installation bookings require 48 hours notice for cancellation
9.2 Returns
- Products may only be returned if defective or not as ordered
- Customer bears return shipping costs unless product is defective
- Returned products must be in original condition and packaging
10. RISK AND TITLE
10.1 Risk Transfer Risk in products passes to customer upon delivery or collection.
10.2 Title Title in products remains with us until full payment is received.
11. FORCE MAJEURE
We are not liable for delays or inability to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, strikes, or supplier issues.
12. PRIVACY
We collect and use personal information in accordance with our Privacy Policy. By using our services, you consent to such collection and use.
13. INTELLECTUAL PROPERTY
All website content, trademarks, and intellectual property remain our property or that of our licensors. Duratuf trademarks and designs remain the property of the manufacturer.
14. DISPUTE RESOLUTION
14.1 Governing Law These Terms are governed by New Zealand law and subject to the jurisdiction of New Zealand courts.
14.2 Dispute Process
- Disputes should first be raised with our customer service team
- We encourage resolution through discussion and negotiation
- Disputes may be referred to mediation before court proceedings
15. GENERAL PROVISIONS
15.1 Entire Agreement These Terms constitute the entire agreement between parties and supersede all prior agreements.
15.2 Amendments We may update these Terms at any time. Updated Terms apply to future orders.
15.3 Severability If any provision is invalid, the remainder of these Terms remain in effect.
15.4 Waiver Failure to enforce any provision does not constitute a waiver of our rights.
